Report submitted by the Inspector-in-Charge, Berhampore P. S., Murshidabad PD through the learned advocate for the State be kept with the record. The present revisional application was preferred at the stage when the Investigating Authority after completion of investigation submitted chargesheet before the jurisdictional court.
Ms. Sharma, learned advocate appearing on behalf of the State has submitted a report dated 16.02.2022 of the Police Authorities which reflects that the present case is pending before the jurisdictional court.
Ms. Roy, learned advocate appearing on behalf of the petitioners has submitted that the petitioners are yet to receive the papers and documents under Section 207 of the Code of Criminal Procedure.
Having regard to the same, I am of the opinion that the present revisional application was preferred at a prematured stage. Petitioners would be at liberty to agitate the points canvassed in the revisional application at the appropriate stage before the jurisdictional court.
No interference can be made by this court at this stage.
Accordingly, the present revisional application being CRR 3057 of 2017 is disposed of.
The CRAN application being CRAN 1 of 2017 filed in connection with the main revisional application is disposed of accordingly.
Inter order, if any, is hereby vacated.
