Chatterjee .... For the Respondent nos. 7-8 Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The petitioner is a septuagenarian person and alleges that he has been duped of a huge amount of money by the private respondent no. 9 who called up the petitioner and approached him to invest the said amount for attractive returns. It was detected that the amount was deposited in the personal account of the private respondent no.
9 and not in the account of HDFC Life Insurance Company Limited. A separate complaint has been lodged by the HDFC Bank against the private respondent no. 9 in this regard. Learned counsel for the petitioner submits that after the writ petition was filed, the police authority has registered the complaint of the petitioner as FIR and has started investigation. However, the petitioner was not called by the police and no relevant document has been seized from him.
Per contra, learned counsel for the State submits that the petitioner did not appear before the police authority despite several attempts to contact him. FIR was registered on 28th October, 2025.
Learned counsel for the private respondent no. 9 denies and disputes the allegations made by the petitioner and submits that another complaint on the same issue was filed by some other person before the Eco Park police station. The private respondent no. 9 was arrested in the said case and subsequently released on bail. Charge sheet has been submitted therein.
Be that as it may, since investigation in respect of the complaint lodged by the petitioner has commenced, it is expected that the police authority shall conduct such investigation promptly and fairly in accordance with law. With the above observations and directions, the writ petition is disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
