Mr. Lalratan Mondal ... for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff/appellant praying for a direction upon the learned Additional District Judge, 3rd Court, Howrah to dispose of the Title Appeal No. 30 of 2021 expeditiously.

The learned advocate appearing for the petitioner submits that an application under Section 151 of the Code of Civil Procedure is also pending. In view of the order sought and proposed to be passed, there no necessity to direct issuance of notice upon the opposite party. However, the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned judge of appellate court.

From the ordersheets appended to this application this Court finds that 6th December, 2025

has been fixed for hearing of the application under Section 151 of the Code of Civil Procedure.

In the light of the submissions made by the learned advocate for the petitioner, C.O. 3512 of 2025 stands disposed of by requesting the learned Additional District Judge, 3rd Court, Howrah to take up the hearing of the application under Section 151 of the Code of Civil Procedure on the next date fixed i.e. on 6th December, 2025, if the same is otherwise ready for hearing, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

After disposal of the interlocutory application the learned judge of the first appellate court shall make an endeavour to dispose of the title appeal expeditiously.

No order as to costs.
