1. The petitioner has come up before this Court claiming to be Indian National and he is in custody of 79 days.

2. Learned Prosecution raised strong objection and draws attention of this Court to the case diary whereby the petitioner having Bangadeshi Voter Identity Card. That apart, the learned Trial Court also found deviation of the name of the father. The investigation is still going on.

3. Therefore, considering the facts and circumstances and the nature of allegation imposed, this court inclined to pass a favourable order to the petitioner at this stage.

4. Accordingly, the application being, CRM(M) 1754 of 2025 stands disposed of as rejected.
