The petitioner of the instant application under Article 227 of the Constitution of India is the plaintiff no. 1 in a suit for declaration of title and injunction being Title Suit No. 106 of 2021 pending before the Additional Court of learned Civil Judge, (Junior Division), at Asansol, District - Paschim Bardhaman.

The learned Trial Judge by the order impugned being Order No. 44 dated July 27, 2024 has dismissed an application filed by the petitioner for holding local inspection of the suit property by a Survey Passed Commissioner.

The summons upon the defendant no. 2 has not yet been served, the learned Trial Judge has therefore rightly dismissed the application of the petitioner as pre-matured; the order impugned therefore does not call for any interference.

C.O. 3283 of 2024 is dismissed without any order as to costs.
