Very astonishingly this writ application is pending at the 'Motion' stage from 2009. It seems to have appeared in the list and been adjourned from time to time.

On the basis of an order of this court dated 10th July, 2002 in the writ application [W.P. 7652(W) of 2002] the petitioner was granted electricity connection by the respondent no. 1 at premises No. 16/5, Raja Manindra Road, Kolkata-700 037.

By this writ, the petitioner wants enhancement of the load to 440 volts as pleaded in the writ petition. I have heard Mr. Ghosh, learned advocate for the petitioner and Dr. Saha Roy, learned advocate for the respondent licensee.

The case of the petitioner is worth consideration by the respondent no. 1, in my opinion.

I dispose of this writ application by directing the respondent no. 2, the District Engineer, Northern District, C.E.S.C. Limited, Northern Regional Office to

consider the case of the petitioner as made out in the writ petition and to pass a reasoned order after giving a short hearing to the petitioner or his lawyer by 31st March, 2022.

As affidavits were not invited, the allegations contained in the petition are deemed not to be admitted. (I.P. MUKERJI, J.)
