Banerjee) Mr. Animesh Paul Ms. Manisha Upadhyay ...for the petitioner This application under 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 5th Court at Howrah to dispose of Matrimonial Suit No. 852 of 2009, renumbered as Matrimonial Suit No. 1496 of 2014 expeditiously.
Learned advocate appearing for the petitioner submits that the wife/opposite party is delaying the hearing of the matrimonial suit. He further submits that the learned trial judge has issued a show-cause against the opposite party. He further submits that the petitioner is paying alimony pendente lite to the wife regularly.
In the light of the submission made by the petitioner CO 3286 of 2024 stands disposed of by requesting the learned Additional District Judge, 5th Court at Howrah to make an endeavour to see that Matrimonial Suit No. 1496 of 2014 is disposed of as
expeditiously as possible, subject to the business of the court, without granting any unnecessary adjournment to either of the parties, provided that the husband is not in default in payment of alimony pendente lite.
