1. Affidavit of service filed in Court today is taken on record.

2. The petitioner seeks restoration of electricity connection which stood disconnected on the ground of non-payment of the bills raised on account of unauthorized use of electricity.

3. According to the petitioner, he is no way connected with the bills which have been directed to be paid. The petitioner is a different consumer and no notice was served upon him prior to the disconnection being made.

4. Learned advocate representing CESC Limited submits that, there is a nexus between the erstwhile consumer and the petitioner herein. There is unauthorized use of electricity and on detection of the same, bills were raised. For non-payment of the bills, electricity line has been disconnected.

5. The authority under the law to decide such dispute is the Grievance Redressal Officer. The said Grievance Redressal Officer has not been impleaded as party respondent in the instant writ petition.

6. Leave granted to the learned advocate on record of the petitioner to implead the Grievance Redressal Officer as party

respondent in the instant writ petition and serve a copy of the writ petition upon the Grievance Redressal Officer.

7. It will be open for the petitioner to raise a formal grievance before the concerned Grievance Redressal Officer. In the event, such a grievance is raised, the said Officer shall consider the same in accordance with law at the earliest upon giving a reasonable opportunity of hearing to the petitioner to place his case. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

8. The writ petition stands disposed of.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
