The writ application has been preferred praying for direction upon the respondents to take all steps under Section 29 read with Section 32 of the Act, 1947 for continued violation of the award dated July 21, 1998 as passed by learned First Industrial Tribunal, West Bengal in Case No. VIII-16/94 in accordance with the law within a specified time frame.

It is the case of the petitioner that the 1st Industrial Tribunal passed an award on 21.7.1998.

It is further stated that a criminal case against the accused persons was disposed of by the

criminal Court vide an order dated 6.3.2009.

It is further submitted that a coordinate Bench of this Court vide a judgment dated 15th January, 2024 passed in WPA 20201 of 1998 was pleased to dismiss the writ application filed by the company respondent herein. The Division Bench also dismissed the said appeal against the said order. SLP was also dismissed.

It is submitted that in spite of the matter having been decided upto the Hon'ble Supreme Court, the Government authorities are not acting in accordance with law for which the petitioner herein is being prejudiced.

It is submitted that the petitioner has placed a representation before the respondent authorities on 13th May, 2025 and another on 20.6.2025 but the same have not been disposed of till date.

On hearing the parties, the writ application is disposed of with the direction that the respondent authorities shall dispose of the said representation on hearing the parties and acting in accordance

with law as per the direction of the orders passed by various Courts in this case within a period of 60 days from the date of communication of this order. In case copies of the representation is not available with the respondent authorities , the petitioner shall be at liberty to place the copy of the same which shall be disposed of as directed.
