Mr. Arunava Ganguly ... for the petitioner Learned Advocate for the petitioner appears and submits that the subject matter of this revisional application relates to conviction and sentence which has been wrongly preferred. Petitioner intends to prefer an appeal before the jurisdictional appellate court. Accordingly, CRR 3566 of 2023 is dismissed as not pressed. Liberty is granted to the petitioner to prefer appeal before the jurisdictional appellate court. In case there is delay, the learned appellate court will consider the pendency of the revisional application before this Court as a ground of delay and would see that the litigant should not suffer because of inadvertent legal advise. Department is directed to return the certified copy to the learned advocate upon receipt of photostat copy of the same.
