The learned advocate for the petitioner submits that a work order had been issued for construction of household latrines under "Swachh Bharat Mission". The petitioner submits that such household latrines were constructed in 2015, but the payment had not been released so far. Only a paltry sum of Rs. 15,000/- had been paid.

The writ petitioner made several representations before the authorities which had not been considered.

Without assessing the merits of the claims of the petitioner and without expressing any opinion as to whether the petitioner had actually completed the work or not, this writ petition is disposed of with a direction upon the Block Development Officer, Haripal to treat the writ petition as a representation and to dispose of the same in accordance with law.

The petitioner, the Pradhan of the concerned Gram Panchayat and any other interested party must be heard. A reasoned order shall be passed and communicated to all.

If the claim of the petitioner is found to be genuine, the payment shall be released accordingly. However, if there are reasons to hold that the claim of the petitioner is not genuine, such reasons shall be assigned in the order to be passed by the concerned authority on the basis of the direction of this court.

The entire exercise shall be completed within a period of six weeks from the date of communication of this order.

The petitioner is directed to serve a copy of the writ petition along with a server copy of this order upon the concerned Block Development Officer for necessary compliance.

The writ petition is disposed of.

There will be, however, no order as to costs. All the parties are directed to act on the server copy of this order.
