Rakib (Rejected) CRM (M) 1757 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Mallarpur Police Station Case No. 312 of 2024 dated 29.12.2024 under Sections 126(2)/103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

Learned advocate appearing for the petitioners submits that the petitioners are innocent of the charges and they have been falsely implicated in connection with the instant case. Learned advocate also submits that there are serious contradictions and embellishments in the evidence which justifies release of the petitioners on bail. Mr. Banerjee, learned advocate appearing for the State produces the Case Diary and relies upon the statement of the witnesses. Additionally, it has been submitted by the State that 10 witnesses out of the proposed 24 witnesses have already been examined.

Having regard to the manner in which the trial of the case is progressing, I am of the opinion that the prosecution

should complete another 4 more witnesses by 15th of January, 2026. The said witnesses are those who are not associated with the Government Department. In case these 4 witnesses are not completed by 15th of January, 2026, petitioners would be at liberty to renew the prayer for bail.

It is reiterated that the petitioners would cooperate with the learned trial Court in progress of the evidence of the case. No unnecessary adjournments should be granted and the evidence of the case would continue in spite of any resolution of the local Bar.

Accordingly, CRM (M) 1757 of 2025 is dismissed. Case Diary be returned to the learned advocate appearing for the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
