1. Learned counsel for the appellant after arguing some time, seeks to withdraw this intra-court appeal with the liberty to file an interim application raising the issue of permission of "work from home".

2. Learned counsel for the department vehemently opposed the withdrawal of the intra-court appeal by permitting the appellant to file such application.

3. We do not see any merit in such objection when appellant intends to withdraw his own intra-court appeal with the liberty to file an interim application. Thus, such frivolous objection is rejected. Department may raise objection when such an application is filed before the learned Single Judge. Accordingly, the intra-court appeal is permitted to be withdrawn with the liberty to file appropriate application.

4. It is made clear this court has not expressed any opinion on merits. After filing such application,

the appellant may pray for listing of this matter before the appropriate Bench on out of turn basis. (Sujoy Paul, J.) (Smita Das De, J.)
