(Through Video Conference) Ms. Moumita Ghosh.............For the petitioner. This is a writ of 2009. It appears to have been moved on 14th December, 2009 when interim order was refused but directions were made for filing of affidavits. No affidavit is on record.

Ms. Moumita Ghosh, learned advocate, the junior of the recorded advocate for the petitioner Mr. Sukumar Ghosh submits that the writ petitioner is dead. She is unable to disclose the date of death of the petitioner but says that he has not contacted his advocate for several years.

Furthermore, I notice that this writ challenges a notice of recovery dated 1st August, 2009 issued by the Allahabad Bank under Section 13(2) read with Section 13(13) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

On the face of it, the writ does not seem to be maintainable.

Considering the above issues, this writ application is dismissed.
