Petitioner complains of being thrown out of the property as he was tenanted in respect of a flat measuring about 1050 Sq. Ft. situated at 9, Jalia Para, 1st Bye Lane, Howrah.

The police report which reflects that Title Suit no. 287/12 is renumbered as 9671/14 is pending before the learned Civil Judge (Junior Division), 3rd Court, Howrah. Petitioner complains that on 18.08.2025 when his brother visited the tenanted flat he discovered that the private respondent had already taken possession of the premises by affixing their own name plate and installing CCTV cameras. Police authorities on receipt of such information has already recorded G.D.E nos. 634 and 2269 respectively on 09.07.2025 and 29.08.2025. An enquiry was also conducted by examination of the neighbours.

Having considered that the present application is for registration of FIR, petitioner, if he has documents in his possession would approach Jurisdictional Magistrate under the relevant provisions of law, who would address the issue by assessing and ascertaining the genuinity of the allegations.

With the aforesaid observations WPA 22733 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
