1. Heard learned Advocate for both the parties.

2. From the materials as placed before us it reveals that the present accused petitioner is named in the FIR along with three other accused persons. From the statement of the victim as recorded under Sections 161 and 164 Cr.P.C., we find the prima facie role of the present petitioner along with other accused persons in the entire transactions.

3. Regard being had to the gravity of the offence and serious nature of the crime, we are not inclined to exercise our discretion in favour of the petitioner under Section 438 Cr.P.C.

4. Accordingly, the prayer for the anticipatory bail is rejected.
