It is alleged that the petitioner's prayer for grant of higher scale of pay on enhancement of his educational qualification is pending consideration before the District Inspector of Schools (SE), South 24 Parganas for a considerable period of time.

Reliance, in this context, has been placed on the judgment passed by the Hon'ble Special Bench of this Court on February 7, 2024 (Utpal Kanti Karan -vs- State of West Bengal & Ors.) in a batch of writ petitions one of which is WPA No.9921 of 2007.

Without entering into the merits of the claim of the petitioner, the instant writ petition is disposed of by directing the concerned District Inspector of Schools to decide the petitioner's prayer strictly in accordance with law and in line with the judgment mentioned hereinabove at the earliest but positively within a period of twelve weeks from the date of communication of this order. 4.

If the prayer of the petitioner is allowed, then

necessary consequential steps shall be taken without any further delay.

If the prayer is rejected, then a reasoned order disclosing the ground(s) of rejection shall be passed and communicated to the petitioner.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
