Accordingly, C.O. 3269 of 2023 is disposed of by requesting the learned Civil Judge (Senior Division), 5th Court at Alipore to take up hearing of the applications under Order 22 Rule 4, and Order 1 Rule 10(2) of the Code of Civil Procedure as well as the application under section 5 of the Limitation Act on the next date fixed, if the same are otherwise ready for hearing and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
