The petitioner is a nursing institution seeking to increase its intake capacity of students from 60 to 100 for the General Nursing and Midwifery Course. The petitioner made an application before the Indian Nursing Council on May 31, 2023. Following that, an inspection was carried out by the Indian Nursing Council on October 9, 2023 and October 10, 2023. Learned advocate appearing for the petitioner submits that the Indian Nursing Council should expedite the process for granting suitability certificate for the increase of seats so as to enable the petitioner to participate in the ongoing counselling process for admission. The outcome of the inspection has not yet been published.

At this juncture, no direction can be issued to allow the petitioner to take part in the ongoing counselling process. It is,

however, desirable that the Indian Nursing Council shall complete the process for granting suitability certificate in accordance with law as expeditiously as possible preferably, within a period of two months from the date of communication of this order.

It is needless to mention that the Council shall decide the application of the petitioner without being influenced by any observations made in this order.

Accordingly, WPA 22347 of 2023 is disposed of. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
