Allowed that the petitioner was implicated in connection with the instant case for alleged recovery of 300 bottles of phensedyl and is in custody for a period of 1 year 4 months since he is surrendered before the learned special court. The petitioner prays for bail on any stringent conditions.

Learned advocate for the State opposes the prayer for bail and submits that initially petitioner was granted bail after three months thereafter he absconded for a period of about six years and presently he is in custody for 1 year 4 months. I have taken into account the conduct of the accused which is not at all satisfactory but as a chance and the fact that there is no possibility of the trial being concluded in near future, his prayer for bail is allowed.

Accordingly, the petitioner namely, Minarul Sk. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Berhampore, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the district of Murshidabad without prior permission of the learned special court.

Accordingly, CRM (NDPS) 1182 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
