Petitioner is aggrieved by the factum of pendency of Misc. Case No.100/63 of 2022 which is pending before the learned Judicial Magistrate, 3rd Court, Bishnupur. The proceedings are under Section 125 of the Code of Criminal Procedure. The grievance of the petitioner is that neither the application under Section 125 of the Code of Criminal Procedure is progressing nor the interim maintenance application is being disposed of by the learned Magistrate.

Having regard to the period of time which has expired in the meantime, I direct that the learned Magistrate on 30th September, 2023 would take efforts for disposing of the application for interim maintenance. If the same is not possible on the said date, the learned Magistrate would continuously fix dates till the application for interim maintenance is disposed of. So far as the main proceedings are concerned, learned Magistrate would thereafter fix one date in every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, CRR 3571 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
