None appears for the petitioner either physically or through virtual mode at the time of call. No accommodation has been prayed for either.
This is a writ petition of the year 2009 challenging a notice dated 12th June, 2009 issued by the Engineer-in-Charge, Executive Engineer, Head Works Division-1, Farakka Barrage Project directing the petitioner to attend for a joint measurement, failing which the work will be measured by the department unilaterally in the petitioner's absence and the result of the measurement will be final and binding on him.
The petitioner also prayed for an interim order restraining the authorities from forfeiting the security deposit.
It appears from the order sheet that the prayer for interim order was refused by an order dated 14th December, 2009.
Order sheet reflects that that the petitioner is not interested to move the instant writ petition and
it appears that nothing survives to be decided in the instant writ petition.
Accordingly, the instant writ petition stands dismissed for default.
