Supplementary affidavit and affidavit of service filed on behalf of the petitioner are taken on record. The petitioner complains that the private respondent financier has, notwithstanding settlement of the hire purchase dues, sold the vehicle to a third party. The financier is represented. Learned counsel for the financier submits that her client has been cheated by their employees in collusion with the petitioner. The petitioner as well as the financier lodged complaints with the police.
The petitioner's complaint has been registered as FIR being Kharagpur (Local) Police Station Case No.501 of 2022 dated 23rd August, 2022 under sections 420, 406 of the IPC.
Learned counsel for the State has produced a report in the form of instructions issued by the Inspector-inCharge, Kharagur (Town) Police Station, Paschim
Medinipur addressed to the learned Government Pleader and the same is taken on record.
Mr. Sen, learned counsel for the State submits that one of the accused named in the FIR has already been arrested and has been enlarged on bail. The investigation is on.
Let the investigation in the aforesaid FIR be completed by the Kharagpur (Local) Police Station mandatorily and positively within a period of one month from date.
With the aforesaid directions, the writ petition shall stand disposed of.
There shall be no order as to costs.
Since the respondents have not used any affidavits, the allegations made in the writ petition, shall not be deemed to have been admitted by them.
