1. Affidavit of service filed in Court today is taken on record.

2. The writ petition arises out of a tender floated by the South Bengal State Transport Corporation in February. 2024. The writ petition was filed in September, 2024, after issuance of the work order in August, 2024. By this time, five months of work is over. The successful bidder is continuing with the work.

3. The petitioner alleges that the respondent authorities illegally selected the successful bidder contrary to the terms and conditions of the bid document.

4. I am of the opinion that, as nearly five months are over after issuance of the work order, at this stage, disturbing the successful bidder in completing the subject work will be against public interest.

5. The Court is, accordingly, is not inclined to interfere with the writ petition.

6. The writ petition stands disposed of.

7. It will be open for the petitioner to approach the competent forum for compensation or any other remedy, if available in law.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
