Banerjee) Ms. Laboni Bar ...for the petitioners Mr. Sukumar Bhattacharya Mr. Shailendra Kumar Mishra ...for the Union of India Mr. Bhattacharya, learned advocate appearing for the respondent draws the attention of the court to the statements made in paragraph 20 of the writ petition and submits that certain allegations have been made against the private parties who have not been impleaded as a respondent in this writ petition. Learned advocate appearing for the petitioner submits that the petitioner has only prayed for consideration of his representation.

However, since certain allegations have been made against private parties and such private parties have not been impleaded as party-respondents in this writ petition, the petitioner has to take appropriate steps in that regard.

Faced with such situation learned advocate appearing for the petitioner prays for leave to withdraw this writ petition with liberty to file afresh on the self-same cause of action.

In the light of the submissions made by the learned advocate appearing for the petitioner, this writ petition stands dismissed as withdrawn with liberty to the petitioner to file afresh on the self-same cause of action.
