24.09.2024 AD-07 Court No.29 TN (Allowed) CRM (A) 3312 of 2024 In Re:- An application under Section 438 of the Code of Criminal Procedure, 1973 corresponding under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kharagpur Local Police Station Case No. 503 of 2024 dated 21.06.2024 under Sections 498A/323/325/307/354(A)/509/34 of the IPC, 1860 and Sections 3 & 4 of the Dowry Prohibition Act, 1961.

1. Heard the learned counsel for the parties.

2. Considering the materials available in the case diary, the nature and extent of complicity of the petitioner in the commission of the alleged offence, the injury report which shows that the nature of the injury is simple, we are of the view that custodial interrogation of the petitioner is not necessary.

3. Accordingly, we direct that in the event of arrest, the petitioner, namely, Sanjay Mallik shall be released on bail upon furnishing a bond of Rs.10,000/-, with two registered sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid Signed By :

4. The petitioner shall meet the Investigating Officer once in a week till submission of the final report and shall not leave the District Paschim Medinipur without the permission of the Trial Court.

5. It is further directed that the present accused petitioner shall appear before the learned Chief Judicial Magistrate at Paschim Medinipur within two weeks from date.

6. Accordingly, the application for anticipatory bail is disposed of.
