The matter relates to the alleged unauthorized construction in holding nos.33/2/1 and 33/2/2, Kailash Bose Lane, P.S. Howrah, Ward No.28 under the jurisdiction of Howrah Municipal Corporation. It appears from the submissions made on behalf of the parties and upon perusal of the materials on record that in response to the complaint lodged by the petitioner, a hearing was conducted on 25th July, 2022. Final order has not been passed yet. The petitioner prays for a direction upon the Howrah Municipal Corporation to pass final order.

Learned advocate appearing for the private respondents submits that, part hearing was held on 25th July, 2022 and the hearing is yet to be concluded.

As it appears that the Howrah Municipal Corporation has already entertained the complaint lodged by the petitioner and took hearing on 25th July, 2022, it is incumbent for the Corporation to decide the complaint filed by the petitioner without any further delay.

In view of the above, the Assistant Engineer, Borough-IV, Howrah Municipal Corporation, being the respondent no.5 herein, is directed to conclude the hearing and pass a reasoned order in the matter at the earliest, but positively within a period of two weeks from the date of communication of this order. If required, the authorities shall cause a spot inspection upon prior notice to all the necessary parties. The final order shall be passed and communicated to the parties immediately thereafter.

The writ petition stands disposed of.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties on compliance of necessary formalities.
