The subject matter of the writ petition relates to an order of termination passed against an employee of the State Government. As such, the appropriate tribunal is the Court at the first instance, under the Administrative Tribunals Act, 1985.
Therefore, this Court does not have the jurisdiction to receive, try and entertain the present writ petition.
Accordingly, WPA 23970 of 2017 is dismissed, with liberty to file afresh.
It is made clear that this Court has not gone into the merits of this writ petition.
If the parties approach the appropriate tribunal within three months from date, the case of the petitioner may be considered on merits without raising the issue of limitation.
All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.
