Petitioners complain that in spite of an injunction order passed in Title Suit No.161 of 2025 by the learned Civil Judge (Senior Division), 3rd Court, Alipore, construction work is in progress by violating the order of the civil court. Learned advocate further submits that an application under Section 151 of the Civil Procedure Code has been preferred before the learned civil court for police assistance, however, the same is pending.

Learned advocate for the State has submitted a report. Report reflects that the construction work which has been carried out was in adherence to the Municipal Act and Rules. Report also reflects that

Title Suit No.1557 of 2025 has been filed against the petitioners which is also pending.

In view of the application under Section 151 of the Civil Procedure Code praying for police help is fixed on 20th November, 2025, I direct the learned Civil Judge (Senior Division), 3rd Court, Alipore to dispose of the said application within a period of 30 days from the next date so fixed. If any direction is passed upon the police authorities, the same be respected, obeyed and implemented.

With the aforesaid observations, WPA 22933 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
