CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 2581 of 2013 In Re : Subhendu Pal ........Petitioner.

In the matter of : An application under Section 401 of the Code of Criminal Procedure.

The present revisional application has been preferred against the order dated 22nd April, 2011 passed by the learned Judicial Magistrate, 5th Court, Howrah thereby awarding maintenance of Rs.3000/- per month to the opposite party/wife in connection with Misc. Case No. 343 of 2010(M. R. Case No. 343/2010) under Section 125 of the Code of Criminal Procedure.

I have perused the order so passed by the learned Magistrate and I find that the learned Magistrate has considered the materials on record while arriving at the quantum to be awarded for maintenance. Further, the sum of Rs.3000/- per month which has been awarded in consonance with the cost of living and the relevant period when the order was passed by the learned Magistrate.

Having regard to the fact that the order was passed more than 10 years ago, I do not find any scope of interference at this belated stage.

Accordingly, the present revisional application being CRR 2581 of 2013 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby disposed of. All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
