Report filed on behalf of the State regarding intimation to the private respondents, as filed in Court is taken on record. It appears that the private respondents could be served with notice. Despite this, they have chosen not to represent themselves.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the owner of the property in question. He wants to return to his house. He is afraid that the private respondents and their accomplices may do some harm. There is a political rivalry between two sides. Unless police protection is given, the petitioner would not be able to reside at his own residence.

Learned counsel appearing on behalf of the State relies on the report and submits as follows. A factional rivalry is there between two groups belonging to the ruling political dispensation. Two criminal cases had earlier been started against the present petitioner. A murder case was started against the other side. Although the relatives of the petitioner

are staying at the village, the petitioner out of fear does not want to come back. The police authorities have shared their contact numbers for any help that he may seek, but he has not returned home.

In the event the petitioner wishes to return to his residence at the village, he shall be at liberty to do so. If he requires police assistance for the purpose, he shall make an appropriate prayer before the Officer-in-Charge of Monteswar Police Station, who shall then act in accordance with law. Even otherwise, the police authorities shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. The surveillance shall include frequent visits by police patrol.

With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
