The petitioner participated in the selection process of the year 2009 conducted by the DPSC, Malda. Recruitment process whereof is completed in the year 2015. Result of such process could not be published in view of pending litigation.

The prepared panel was finally declared and appointments made pursuant to the order of the Coordinate Bench dated 08.01.2021 passed in WPA 15128 of 2017 (Nihar Biswas and others Vs. State of West Bengal and others). The petitioner, who got the benefits of the said order, had only about seven odd years of service. He claims that his services should be notionally considered from the year 2015 till the date of actual appointment to enable them to avail terminal benefits like pension etc.

This Court has serious reservation about the maintainability of the instant writ petition.

Mr. Sarwar Jahan, learned counsel for the petitioner seeks leave to withdraw the writ petition and pursue other available remedies in accordance with law.

With leave reserved to the petitioner as indicated above, the instant writ petition is dismissed as withdrawn.
