Mr. Debabrata Sardar ..for the petitioner Ms. Rupsa Chkaraborty Mr. Samrat Paul ..for the State It is the case of the petitioner that he, along with others, purchased the relevant property by way of a registered deed of conveyance from one Mitali Pal. The petitioner further submits that respondent nos. 6 and 7 are claiming ownership in respect of the relevant property on the basis of a forged and fabricated deed purportedly executed by the other co-owners.

It appears that the petitioner has filed a Title Suit being no.84 of 2023 before the learned Civil Judge (Senior Division), Baruipur for declaration of his right over the said property without impleading respondent nos. 6 and 7 as a party to the suit.

The petitioner alleges that respondent nos. 6 and 7 have made an unauthorised construction over the premises in question.

I am of the view that since the title of the parties is disputed before the Civil Court, the petitioner can very well approach the said Court seeking appropriate relief.

In the given facts, I am not inclined to entertain this writ petition.

With the aforesaid observations, WPA 22374 of 2023 is disposed of.
