1. The affidavit of service is taken on record.

2. Heard the learned counsel for the petitioner. The petitioner has approached the West Bengal Administrative Tribunal (in short 'Tribunal') challenging the show-cause letter dated 11th April, 2025 issued by the Deputy Assistant Director, Consumer Affairs & F.B.P., Chanchal R.O., which reads as follows:

"Sub: Show Cause Letter As per order no.199/C&F/MLD dated 04.03.2025 of Consumer Affairs & F.B.P., Malda Regional Office, you have been released from Malda R.O. on 4th March, 2025, afternoon with direction to join Chanchal R.O. But till today you have not reported to Chanchal R.O.

Secondly, it appears you are absent in Chanchal R.O. without prior intimation.

Thirdly, you have directly approached & informed in written version about your queries to Deputy Secretary,

Consumer Affairs Department, Govt. of West Bengal, without moving through proper channel.

You are directed to furnish a satisfactory replies of the explanations called for due to such irregularities on your part, within three days from the date of receiving the letter, failing which stringent actions will be initiated against you as per extent norms.

3. The learned counsel for the writ petitioner submits that he has filed an Original Application being O.A. No.463 of 2025 assailing the show cause letter but, since the Tribunal is presently without any Member, thus, he has approached this court directly.

4. We have called upon the learned counsel for the petitioner to submit as to what is the illegality in issuance of the show cause letter seeking explanation. He has tried to argue that there is no cause for issuance of such explanation, seeking his reply thereupon.

5. We find no force in such submission at this stage since the letter merely asked for an explanation as to why the petitioner, who is a Consumer Welfare Officer, has not complied with some transfer order.

6. Without going into the merits, whether the petitioner has complied or not, leaving all issues open, we find no reason to interfere in the

matter at this Stage having regard to the nature of relief and since the matter is pending before the Tribunal.

7. After the order was dictated, the learned counsel for the petitioner submits that he will be withdrawing the O.A. and seeks liberty to submit his reply to the show cause notice.

8. With liberty, as prayed for, we dispose of the writ petition.
