For the State Learned Advocate for the petitioner submits that the petitioner is in custody for one year and ten months. Charge has already been framed in this case, but, there has been no progress in the trial of the case.

The petitioner is directed to serve a copy of this revisional application upon Ms. Manisha Sharma, ld. advocate, who ordinarily appears on behalf of the State. Her appearance may be regularised by the concerned authority. Ld. advocate submits that on 18th October, 2023, date has been fixed by the ld. Special Court for fixing schedule of dates.

Having regard to the stage of the case and the period of detention of the present petitioner, I direct that the

ld. Trial Court, henceforth, would fix a schedule consisting of three days and fix such schedule once in every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. If, no witness is present, in that case, direct communication be made to the Superintendent of Police of the concerned district, who would take steps for ensuring the appearance of the witnesses. No unnecessary adjournment should be granted to either of the parties. Ld. Public Prosecutor conducting the case would produce the documents, materials and exhibits on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the ld. Trial Court for concluding the trial at the earliest.

With the aforesaid observations, CRR 3574 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
