Learned advocate appearing for the petitioner submits that the petitioner is in custody for 129 days and he has been implicated on the basis of statement of the co-accused. Petitioner prays for bail on any stringent condition. Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of the present petitioner.

Learned advocate for the State submits that in the other case also petitioner is on bail and he has also been implicated in connection with that case on the basis of statement of the principal accused.

I have taken into account the records of the case. Neither any money trail nor any call data records are available. Having regard to the same including the period of detention I am of the view further custodial detention is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Hasibul Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court (NDPS Act), Nadia at Krishnanagar. If on bail, petitioner shall meet with the Investigating Officer once in a fortnight till further orders of this court. Petitioner shall not leave the District of Nadia without the permission of the learned Special Court.

Accordingly, CRM (NDPS) 1198 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
