1. Heard learned Advocates for the parties.

2. Petitioner is in custody for over a month. He submits he has been falsely implicated in this case. He prays for bail.

3. Learned lawyer for the State contends stolen articles were recovered from the petitioner. He has criminal antecedents.

4. We have considered the materials on record. Stolen articles have already been recovered. Investigation is complete. However, petitioner has criminal antecedents.

5. Under such circumstances, we are inclined to enlarge the petitioner on bail but on strict conditions.

6. Accordingly, the petitioner, namely, Popin Sk. @ Sohel Ahamed @ Sohel Ahmed shall be released on bail upon Signed By :

furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Kandi, subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever or commit similar offences in future and on further condition that the petitioner shall report to the Officer in charge, Kandi Police Station once in a week until further orders.

In the event petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
