Petitioners are directed to serve a copy of the revisional application upon Ms. Ratna Ghosh, learned advocate who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. Learned advocate for the petitioners submits that the petitioners are in custody since 29th May, 2021 and in connection with the instant case, chargesheet has been submitted and subsequently charge has been framed on or about February, 2022. In course of trial, six witnesses have already been examined and the prosecution is yet to complete the examination of five chargesheeted witnesses. In view of the period of detention of the petitioners which is for 29 months, I direct the learned trial court that having regard to

the period of detention henceforth the learned trial court would fix a schedule consisting of three dates and such schedule be fixed once in every twenty-one days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. In case, if any of the witnesses is not appearing or reluctant to appear, be it independent witness or a departmental witness, the learned trial court will communicate with the Superintendent of Police of the concerned District who would take steps for ensuring the presence of the witness on the dates so fixed before the learned trial court.

No unnecessary adjournments should be granted to either of the parties.

The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. All efforts be taken by the stake-holders to cooperate with the trial court so that the trial is concluded within a reasonable period of time. With the aforesaid observations, the present revisional application being CRR 3575 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
