The petitioner is a Trust namely, Alex Institute of Nursing at Purba Bardhaman that offers General Nursing and Midwifery course.

The college seeks to upgrade its status as an affiliated college under the West Bengal University of Health Sciences' to offer B. Sc. in Nursing course. The petitioner applied before the university in this regard on December 02, 2022. In response to such application, the college was advised by the university to change the "Chief Medical Officer of Health Licence" from "Nursing Home to Hospital". It appears that after such change, the first application in terms of applicable regulations was made before the university only on April 27, 2023.

It is the grievance of the petitioner that the university has not taken any step in response to such application which prevented the college to participate in the counselling for the Joint Entrance Test for Nursing, Paramedical and Allied Sciences (Undergraduate Courses) 2022.

The last date of registration of the students in the said counseling was August 31, 2023.

Unless the petitioner is granted the affiliation, it cannot be included in the set matrix for counseling. I do not see any reason to allow the college to be included in the set matrix for the counseling of Joint Entrance Test for Nursing, Paramedical and Allied Sciences (Undergraduate Courses) 2023 at this stage. However, this writ petition is disposed of with a direction upon the university to consider the application for affiliation filed by the petitioner's college on April 27, 2023 within two months from the date of communication of this order.

Accordingly, WPA 22385 of 2023 is disposed of. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
