Mahasin Ali -vs- State of West Bengal Mr. Shraman Sarkar Mr. Sahil Kabir Mr. Tehasin Reja ... for the petitioner This is an application wherein petitioner has prayed for a necessary direction upon the court below to expedite the hearing of GR Case No. 590 of 2023 presently pending before learned Additional Chief Judicial Magistrate, Sealdah. Learned counsel for the petitioner submits that in the instant proceeding since March 28, 2023, the case is pending for submission of final report by the investigating agency. The petitioner being an accused is suffering a lot due to long pendency of the proceeding.

Having heard learned counsel for the petitioner and that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice and as such, service of copy of application upon the opposite party is dispensed with. Having heard learned counsel for the petitioner and that the prayer made on behalf of the petitioner is justified due to long pendency of the proceeding, the instant application being CRR 4294 of 2025 is hereby disposed of with a direction upon the Court below to ask for a report from the investigating agency as to why the investigation had not been completed in spite of expiry of

three years and thereafter to take necessary steps for expeditious hearing of the proceeding, if required.
