Bhattacharya, learned advocate appearing for the State be kept with the record.

The said report reflects that the concerned officer of Patashpur Police Station, Purba Medinipur has no objection if the .32 bore pistol is returned to the petitioner viz. Sanjit Kumar Nayak. So far as the conditions are concerned, it has been submitted that the investigating agency/prosecuting agency would be satisfied, if the same conditions are imposed by the learned ACJM, Contai, Purba Medinipur as was imposed by him while returning the revolver.

Accordingly, I direct that the learned Assistant Sessions Judge, 2nd Court, Contai would pass directions for return of the .32 bore pistol seized in connection with Patashpur Police Station Case No. 62 of 2022 dated 09.02.2022 to the present petitioner viz. Sanjit Kumar Nayak on similar conditions as was earlier directed by the learned ACJM, Contai, Purba Medinipur while returning the revolver.

If this order is brought to the notice of the learned Assistant Sessions Judge, 2nd Court, Contai, the learned

court would dispose of the same on the same date or within a week thereafter.

With the aforesaid observations, the revisional application being CRR 3578 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
