1. Learned counsel for the petitioner contends that the petitioner made representation before the respondent-authorities for removal of unauthorized encroachment in front of the petitioner's property on public land.

2. Learned counsel appearing for the respondent no. 3, that is, the Executive Engineer, Public Works Department, Tamluk Division, submits that appropriate proceeding had already initiated by issuance of a notice under Section 10(1) of the West Bengal Highways Act, 1964 by the said authority.

3. It is contended that the authorities require some more time to ensure that the proceeding reaches it logical culmination.

4. In such view of the matter, W.P.A. No. 22401 of 2023 is disposed of with the expectation that the

respondent no. 3 shall take all necessary steps to ensure that the proceeding initiated by a notice under Section 10(1) of the 1964 Act reaches its logical culmination at the earliest, preferably within three months from date.

5. There will be no order as to costs.

6. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
