Affidavit-of-service filed on behalf of the petitioner is taken on record.

By the present writ petition, the petitioner seeks for direction upon the respondent authorities to allow her prayer for inter-District transfer from Dakshin Dinajpur District Primary School Council to Malda District Primary School Council.

The petitioner contends that she joined as an Assistant Teacher in Dwipkhanda F.P. School under Tapan Circle, District Dakshin Dinajpur on 13th February, 2017. The petitioner has already completed two years of mandatory probation period and accordingly, the service of the petitioner in the said school has duly

been confirmed by the Chairman, District Primary School Council, Dakshin Dinajpur with effect from 13th February, 2019. The petitioner has to travel 87.5 Kilometers (one way), which is causing extreme difficulty for her in attending her present place of posting from her residence. The petitioner has one minor child. On 30th July, 2025 the petitioner made a representation for her transfer before the President, West Bengal Board of Primary Education, respondent no.4. However, the said representation is still pending for consideration. Hence, this writ petition. 4.

Learned Advocate for the petitioner is directed to hand over copy of the writ petition along with its annexures upon the learned Advocates for the District Primary School Council, Dakshin Dinajpur as well as District Primary School Council, Malda.

Mr. Samparno Pyne, learned Advocate appearing on behalf of the petitioner submits that the matter may be relegated to the appropriate authority for considering and deciding the representation of the petitioner dated 30th July, 2025 for her transfer.

Learned Advocates for the respective respondents leave the matter to the discretion of this Court.

In view of the submissions advanced on behalf of the respective parties, the respondent No.5, the Secretary, West Bengal Board of Primary Education, is directed to consider the representation of the petitioner dated 30th July, 2025 and dispose of the same, in accordance

with law, upon notice to the petitioner by passing a reasoned order, within a period of eight weeks from the date of communication of this order.

The reasoned is to be communicated to the petitioner within one week from the date of passing of such reasoned order.

Learned advocate for the petitioner is directed to communicate this order to the respondent no.4, the President, West Bengal Board of Primary Education.

10. With the above direction, the writ petition being WPA 22874 of 2025 stands disposed of.

11. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

12. Interim order, if any, stands vacated.

13. All connected applications, if any, stand disposed of.

14. There shall be no order as to costs.

15. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

16. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
