It is the grievance of the petitioners that a work order for "construction of multivented box bridge over stream namely Sidheswari in between Vill-Joypur & Goabagan within Rajnagar P.S. area (Phase-I) under JAP fund" was issued in their favour by Birbhum Zilla Parishad by an order dated March 5, 2019. The value of the work order was Rs.43,68,926/-.

It is the grievance of the petitioners that though they have successfully executed the work order within the stipulated time period, a sum of Rs.21,54,567/- remains unpaid.

Learned advocate appearing for the petitioners has drawn attention of this Court to the completion certificate issued by Birbhum Zilla Parishad.

Learned advocate appearing for Birbhum Zilla Parishad submits that the petitioners made a representation dated May 15, 2023 before the Zilla Parishad appearing at page 15 of the writ petition and the Zilla Parishad shall consider the same.

In view of the given facts, I dispose of this writ petition with a direction upon Birbhum Zilla Parishad to consider the said representation dated May 15, 2023, within a period of one month from the date of communication of this order.

The petitioners shall be given an opportunity of hearing.

A reasoned order should be communicated to the petitioners within seven days thereafter. With the aforesaid observations, WPA 22409 of 2023 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
