Petitioner is apprehensive of the fact that she may be dispossessed from her possession wherefrom she is carrying on business under a proper trade licence.

Ordinarily this court do not interfere in respect of issues relating to possession.

However I find that a representation was made both to the police authorities as well as the Chairman, South Dumdum Municipality. Until and unless South Dumdum Municipality passes an order the police authorities are not empowered to take any

action so far as the right to possession of the present petitioner is concerned.

In view of the aforesaid I direct that the Chairman, South Dumdum Municipality will dispose of the representation dated 4th October, 2024 after hearing all the parties by 12.11.2024.

Learned advocate for the state will communicate the Chairman, South Dumdum Municipality.

Pursuant to the directions passed by the Chairman, South Dumdum Municipality, the police authorities would exercise their discretion to act in accordance with law.

With the aforesaid observations WPA 23194 of 2024 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
