Learned advocate appearing for the petitioner submits that a representation has been made to the police authorities informing that the private respondents are forcefully trying to grab the property and sell the same, in spite of informing the police station no steps have been taken. Petitioner expected that the police authorities would register a criminal case.

State has submitted a report. Report reflects that a long standing land dispute is existing.

Learned advocate for the respondents support the stand taken by the State.

In view of the report submitted by the State, petitioner would be at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS. Learned Magistrate would assess and ascertain regarding

the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper. In the meantime, police authorities would ensure that there is no violation of law and order and peace and tranquility is maintained.

With the aforesaid observations WPA 22751 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
