The status report submitted on behalf of the State is taken on record.

Upon perusal of the said report it appears that during pendency of this case a chargesheet has been submitted against the petitioner being Chargesheet no. 368 of 2013 dated 28.09.2013 under Section 341/323/506/114 IPC and after taking cognizance learned Chief Metropolitan Magistrate, Calcutta, transferred this case before the learned 12th Metropolitan Magistrate, Calcutta, for disposal of the case. 5.

It further appears from the report that this Court has granted stay of all proceedings for a period of six weeks or until further order, whichever is earlier. The said interim order was not extended subsequently by this Court.

This case pertains to the year 2017. Even on earlier two occasions none appeared on behalf of the petitioners. 7.

In view of the above facts and circumstances, this Court seems that the petitioners are no more interested to proceed with the case.

Accordingly, CRR 3083 of 2017 is dismissed for default. 9.

Interim order, if any, shall stand vacated.

10. Consequently, all pending applications, if any, shall stand disposed of.

11. Let copy of this order be communicated to the Trial Court for information.

12. Let the Case Diary be returned.
