08.07.2021 Item no.23 Ct. No.34 CHC C.R.R. No.2550 of 2014 (Via Video Conference) In Re: An application under Sections 401 and 482 of the Code of Criminal Procedure.

AND In the matter of:- Gurupada Hembram ... petitioner No one appears for the parties.

The subject-matter of challenge relates to an order dated 26.06.2014, passed by the learned Additional Sessions Judge, Kalna, wherein, the learned Sessions Court was pleased to hold arrear maintenance of Rs.24,000/- and segregated the same to eight equal monthly instalments of Rs.3000/- each to be paid by the husband.

At the time of admission of the revisional application before this Court, I find that a coordinate Bench was pleased to direct the petitioner to deposit a sum of Rs.15,000/- and on such condition the execution case would remain stayed. Having regard to the quantum of maintenance being Rs.24,000/- only and the fact that this Court has subsequently not been apprised regarding the deposit being made, I am of the view that further pendency of the revisional application before this Court is unwarranted.

Accordingly, C.R.R.2550 of 2014 is dismissed. Pending applications, if any, are disposed of.

Interim order, if any, is hereby vacated.

Department is directed to communicate this order to the learned court below for compliance within a period of seven days from date.

All parties shall act in terms of copy of this order downloaded from the official website of this Court.
