The present revisional application has been preferred in connection with Complaint Case No. 153 of 2014 which is a proceeding under Section 138 of the Negotiable Instruments Act.

Learned advocate appearing for the petitioner has drawn the attention of the Court to the order dated 28.06.2023 which reflects that execution return of warrant of arrest against the accused is pending.

Records reflect that the examination under Section 313 of the Code of Criminal Procedure is over and the case is fixed for examination of the defence witness.

Having regard to the prayer so made, I direct the learned Judicial Magistrate, 1st Class, Municipal Court, Howrah to take recourse by directing the superior officer of police to execute the warrant of arrest so pending against the accused so that his appearance before the court can be enforced for smooth progress and conclusion of trial preferably within a period of six months from the date of communication of this order.

With the aforesaid observations, the revisional application being CRR 3584 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
