Writ petition is heard in presence of learned advocates representing petitioner and State respondents.

Mr. Ghosh, learned advocate representing the petitioner submits that father of the petitioner was an Assistant Teacher in a Government aided Higher Secondary School who died-in-harness on 30th September, 2023. After death of father of the petitioner an application was made by her on 18th July, 2024 seeking appointment on compassionate ground.

Grievance of the petitioner is in spite of making such application before the District Inspector of Schools (SE), Murshidabad, same has not been decided till date.

Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing the District Inspector of Schools (SE), Murshidabad being respondent no. 3 to take decision on application of the petitioner seeking appointment on compassionate ground by passing a reasoned order by eight weeks from date of communication of this order after granting opportunity of hearing to the petitioner or her representative.

However, while taking decision technical ground of not filing application in prescribed format should not be relevant consideration for rejecting the application of the petitioner seeking appointment on compassionate ground.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
